Commercial Law  

The Commercial Law practice group delivers targeted, specialist assistance in areas of commercial law that apply directly to NSW Government agencies, including:

  • government procurement, such as compliance with the NSW Procurement Board Directions
  • public finance, including advice on regulatory obligations, grants and funding arrangements
  • Crown copyright, including identifying Crown copyright material and advising in relation to the licensing or assignment of Crown copyright
  • revenue and commercial litigation matters.

We provide authoritative and strategic advice to NSW Government agencies on complex questions that arise when commercial and public law issues intersect. This includes when the government is involved in:

  • significant commercial transactions, such as major infrastructure projects or asset divestments
  • major commercial litigation, including in relation to misleading or deceptive conduct claims
  • significant commercial law reforms with whole-of-government implications.

Examples of our work for clients

  • Representing agencies in commercial litigation matters with particular sensitivities for government, such as Roads and Maritime Services v Desane Properties Pty Ltd (CA 2018/161676).
  • Providing legal advice and assistance for major government policy and legislative initiatives, including the development and implementation of the Government Sector Finance Act 2018, the most significant public sector financial reform in more than 30 years
  • Advising on major agency procurements and reforms, including the NSW Procurement Board Direction on Enforceable Procurement Provisions.
